While a great part of the United States was still in its earliest stages, Washington was flourishing with industry. In spite of the fact that the business was enormous, the towns were simply starting to develop. Despite the fact that Washingtonââ¬â¢s waterfront towns offered a lot to its residents, it was the logging business that began everything. In this paper, I will talk about the development of the logging business, explicitly corresponding to Seattle, and the subsequent expansion enterprises in the advancement of what is currently our countries biggest port city. I. The early business: The workers who sat inert during the hide exchanging slow time of year were of incredible worry to George Simpson, occupant legislative head of the Hudsonââ¬â¢s Bay Company in 1821. As he sat in his recently moved structure arranged on the north bank of the Columbia River, he saw the instructing view, in which he saw unlimited stands of thick timber. By request of Simpson, order of the new post, Fort Vancouver, was made sure about by one John McLoughlin and together, the two set up the principal Washington timber factory (Ficken 1987). The factory, which started activity in 1828, was accused of the obligation of providing timber here and there the southern shore of the United States and any place markets were regarded productive. This endeavor empowered the organization to cover costs all through the rest of the year and as indicated by Simpson, ââ¬Å"â⬠¦yielded a serious attractive profitâ⬠(Ficken 1987). The relentless Columbia had demonstrated valuable in moving logs to the port in the Puget Sound. The fruitful Fort Vancouver sawmill comprised the main timber abuse asset in the Pacific Northwest for longer than 10 years. As the business turned out to be increasingly beneficial, the inescapable occurred, and the Americans went toward the Northwest. II. The capability of Seattle is figured it out: In 1851, Arthur Denny and a little team fabricated little log protects on the sea shore of Elliot Bay. As Denny and his gathering perceived the accessibility of timber in the locale, they moved camp to the more secured eastern shores of the narrows to raise offices to process the wood they would before long be collecting (Ficken 1987). As they spread out their settlement, they called their town Duwamps (later to be know as Seattle). The business developed and before long factories were appearing everywhere throughout the shoreline of Washington. vickiburns199855http://www.blogger.com/profile/10383317327630292233noreply@blogger.com0tag:blogger.com,1999:blog-4704287588006341251.post-83908834167829482102020-08-21T07:42:00.001-07:002020-08-21T07:42:05.872-07:00DEAPS 2005DEAPS 2005 I realize I went on this mindblowing trip with MIT 3 years ago and never blogged about it. Well, Im going to now, because someone asked me if I thought DEAPS would be fun. Would it be fun or would it be a waste of time/money? they ask. As someone who theyd heard had participated in a pre-orientation program they thought Id be able to help. Instead, I wrote back, dude hang on Im totally going to blog about this, and didnt for a few days. Thats because I actually got busy with my UROP. Blah blah blah motor trouble turns one way but not the other why me dont leave me alone with this oh for gods sake watch out for the 1000 dollar star plate. It was all resolved and put back together, at least all the screws appear to be in their right holes, in a 10 hour marathon lab day, which was today, and thats why I sit down and write this. The motor is turning. Ive destroyed nothing. Thats a good day. 3 years ago at this time, life couldnt have been moving faster. Who was I? I was a recent graduate of Hamden High School, #6 in my class, good grades fine scores, decent essays, and for some unknown cosmic reason, MIT bound. And from then on, bound to MIT. I say this cause I dont think anyone ever escapes the tether of this place, theres something about these walls, something homely and subtle that just so gently enough creeps its way under your skin, without notice over the course of years, fuses with your bones, phases through the walls of your veins, until at some point you dont know any more where you end and this place begins. Sometimes its so quiet here, or nothing is moving, or everything is moving, or the rush of people you wouldnt believe. I havent decided which of these MITs feels most like home to me. I didnt know all this then. My perception of MIT was all fire and lights. (I was temped in EC during CPW) How much is the real MIT like that? Maybe 5%. And its a good thing, I think. Because, really, you will find your niche. Freshman year I considered an EAPS major (course 12), DEAPS was going to Yellowstone and I was going with them. If youre taking a trip with an Freshman Pre-Orientation Program this year, several factors will probably combine to make this one of the more exhilarating, memorable experiences of your life. I. Everything was a new thing and it lasted forever. 16 kids or so went to yellow stone with me and several professors and graduate students. I was amazed by the most mundane exchanges because they were with MIT students. They were elite company, they were just like me, and I was sure each one of them was smarter than I was. 9 days and 8 nights was the itinerary, if I recall correctly. We would camp in the park, at an altitude of about 8000 feet, near Yellowstone Lake, days would be dry and sweaty, nights would be near freezing. We brought gear. On the first day we flew into bozeman montana felt small against the wide flat terrain and packed into several white vans (to be later christened with various yellowstone-related names, Bison Without A Cause is the one I always tried to ride in) and drove toward the distant mountains. On the way there a flat tire. II. I shared a tent with Tamara and Danielle. It was something like a 6 person tent occupied by 3 people which sounded great at sundown when we were pitching but turned on us right quick as soon as the temperatures plunged and boy did it ever. We coped by huddling in one corner of the tent and leaving the rest empty and cold and air. Some nights I woke up miserable. One night I had to pee and oh how I tried to fall back to sleep and hold it til morning, grappled terribly with the decision and finally moving as little as possible, switched on the flashlight by my pillow and watched my breath in the air for a while working up the nerve. Another night I was sure my head was on fire and I sat up in my sleeping bag and scratched and scratched and I could swear 1000 bugs couldnt have made it itch so bad. A few nights it rained and after the first I never laid out my clothes to dry on the ground outside again. III. Our first full day at the park we walked through a marsh. We were headed to Sylvan Springs, an off-the-map site at Yellowstone gained access to only with a research license (which was pretty awesome for a prefrosh). Getting there sucked. Taking their advice Id dressed in layers. The early morning hours (6am wakeup time) called for sweatpants, 2 sweatshirts and a jacket. Under that I skeptically slipped in a pair of shorts and a black tanktop. We left before 8am. I brought my backpack, which before we even parked our vans (at around 10am), became home to the jacket and both sweatshirts. We were an impressive sight, a 4-van caravan everywhere we went. We were told to keep on our long pants for walking through tall grass. The way there was hours of hiking. Here Ill post a couple pictures I took during the hike. Sylvan Springs had been a lush green tourist mecca. A geological change a few decades ago caused the water in the hot springs to turn into sulfuric acid. Ever since its been oozing down the sides of the hills, killing all the vegetation in its way. Sylvan Springs as we saw it was a whitewashed ghost of its former self. Thats me in the black tanktop. It was still beautiful, as only a sight like that could be. We took some measurements, which even then I saw as symbolic but still made you feel like a bit of a budding scientist. My shoes were soaked, the kids with boots that day were the clear winners, and my pants up to my knee. Thats why I laid them out that night. To dry. I found them in the morning about 20 feet down hill in a wet, muddy, pile. I threw them in the dumpster. My shoes were never rescuable either. They started stinking unbelievably that next night and just only got danker and more horrible as time went on. We cooked at night, vegetarian meal because of the vegetarian in the group. Pasta and corn and all kinds. Lit a fire to keep warm. Bed time was whenever the fire went out. IV. One night it was a clear lovely night and a group of us drove down in a van to the widest open space we could find in the dark (which was, funny enough, a parking lot down by the lake) and looked up. I was seeing the milky way the cross-section of our own galaxy like a broad stroke of a paint brush across the sky and I couldnt believe it. There were more stars than I could take in at once. I stared and stared. It made me dizzy so I laid down on the ground and I kept on staring. Its weird thinking back. Maybe it was then that I developed the love for telescopes, that I decided I could be an astrophysicist. V. We drove by the lake on our way anywhere, every evening it was a dark void and every morning it was brilliant light. V.(a) Sometimes buffalo crossings stopped traffic for hours. VI. I was petrified on the slopes of the petrified forest. We climbed a vertical 1000 feet, some of the way on our hands and knees on loose rocks. The slope was enough to give you vertigo. I was sure I was going to die. I found a fossil. Below us were wide valleys carved out by glaciers during the ice age. They left huge rocks scattered around like dust on the valley floor. On our way up we saw far below us a black bear roaming the clearings. On the way back down after our picnic lunch I got separated from the group and as I passed through the region of the sighting I made as much noise as possible and fashioned a weapon out of sticks. Some time later I slipped on a loose rock on my way down and slid some 20 feet on my butt down the mountain. That night I spent a couple of minutes being really thankful for being alive. VI. Wednesday halfway through the week we each took a $2 shower. The girls got to wash their hair, back in the vans everyone looked beautiful. Smelled great. Laughed a lot. VII. Day trip to the Grand Tetons. A lift took us from 6000 to elevation 10,000 ft. The temperature dropped from 65 to 27 degrees in the broad day. Hiking around up there was tough. A bit of ill-advised running knocked me straight to the ground, I took way longer than I thought possible recovering. The view was unreal. VIII. We climbed to the top of a hill to look down on Grand Prismatic Spring. Later, we found ourselves on another hill facing a beautiful, snaking river. We learned about the microbes that give the hot spring color and mark it out in isothermals, the flood pattern of rivers, the migration of waterfalls, rhyolite rocks and flows, volcanic breccia, kinematic shock patterns by the time we headed back it was starting to look like rain. Sliding down a fault: IX. I snapped pictures here and there. Sometimes it was all I could do to just take it in. The age of the place was written plainly on everything we could see and touch. The gravity of it all was overwhelming. If you stayed really still you could almost feel the earth shift and the mountains turn. Heres something truly impressive. I love this picture: you can see the two layers of deposits one on top of the other put there by 2 giant eruptions, the first of which formed the yellowstone caldera and the yellowstone lake. The bottom layer is 2.1 million years old, the top 650,000. Like a huge, slowly morphing, rocky birthday cake. X. You know, memories are all we have to remind us that weve lived. You dont need to find it in an FPOP, of course. But I always advise freshmen to sign up for them anyhow. Because sometimes its putting MIT in context, sometimes its that feeling of getting out there, sometimes its just what you need for your beginnings on the world stage. And because it is probably just so much better than whatever else you could have planned for the week before orientation. Because, what if it does change your life? Im so excited for you. Now is the best time to be alive. As I said the trip was 9 hot days and 8 cold cold nights. It had begun with a 4 van procession on the wide open roads of the high plains and so thats where it ended. We were so tired we were napping on the floor of the airport. We were so dirty, too. But coming back to Boston to my penguin patterned temp room in EC and showers and beds and classes and changes, I kinda knew instinctively that Id never be the same for it. And I havent. I truly havent. Washington and W. E. B. Du Bois were two of many very influential Black leaders in African American history. These men, though born over a decade apart, shared a common aspiration of obtaining equal rights and sought education for change on the behalf of Blacks. However, the philosophy in which these goals would be achieved differed greatly among the two. Booker T. Washington was born April 5, 1856 in Franklin County, Virginia. His mother was a slave which meant that he too would be considered as a slave. The living conditions of he and his family were extremely poor to say the least. Not only that, Washington would occasionally experience harsh treatments from slave owners who would beat him for unsatisfactory performances of his duties. As a slave, Washington was not allowed to learn how to read and write. Nevertheless, this did not hinder his desire to receive an education. W. E. B. Du Bois was born February 23, 1868 in the predominantly White town of Great Barrington, Massachusetts. Unlike Washington, Du Bois was born after the conclusion of the Civil War. After this point, the United States had implemented the 13th Amendment to the Constitution, which abolished slavery (Slaveryâ⬠¦); meaning he was born free. As a result, he was at liberty to educate himself even among Whites. I met with three different individuals whom were new to training and nutrition. I explained the type of research I was doing, and asked them if they would be comfortable to tell me 3 specific limiting factors they are facing/have faced within their fitness journey. The first individual (Mona)explained thatshe was not including enough vegetables within her diet;she turned to food to help them cope with their emotions;she wasnot completely sure how to plan out healthy balanced meals for herself as no one had ever shown her. I let Mona know that I would be happy to help her tackle these limiting factors taking it one step at a time. We started with the amount of vegetables she has during the day, and I suggested that she keep track of her food she eats during the day in a chart I provided for her. I let her know that would be a good way to start so we can visually see a record of what she eats on a daily basis. I told her we could meet after 3 days to see what her chart display ed on her food choices. This record was also the suggestion for her to keep track of what food she eats as comfort since she stated she eats unhealthy to cope at times. After 3 days Mona and I met and we went over her food record. We discussed how it is important to have a fist of vegetable with each meal, a palm portion of protein with each meal, one cupped handful of carb foods with each meal, and a thumb of fat with most meals (Hatfield, 2018, p.599). We then discussed how this method will also help with her balancing her food groups as well. The last thing we covered was how she could improve on coping with her emotions by subbing an unhealthy food craving with an activity or hobbyshe would enjoy. She liked this idea as itshe felt it could take her mind off of her food, and mood. We discussed the importance of stress management and how it includes rest and recovery-a rested will is a stronger will (Hatfield, 2018, p.606). I let Mona know that I would be happy to continue to h elp her through this process as she appeared to open up to me about her limiting factors. I let her know that I would check back in with her in 3 days to discuss her progress. The second individual (Dianna) explained that she struggles with eating enough protein during her day as her job is very demanding. She tends to not sleep well, therefore only going on 4-5 hours a sleep a night. Third, she said that her meals she eats are do not make her feel full as she does feel that she has time to balance them out. Dianna is under a lot of stress running her own business, and her exercise time is one of her only escapes from her job. I asked her if she felt she could find the time to keep a diary of her foods she eats for a course of 3 days, and she agreed to do so. Before I left the meeting with her I told her we would meet back at the gym in 3 days and go over her food chart.Keep in mind Dianna is 5 3 and 140 pounds. 3 days went by and she met me back at the gym after work and I could see that her breakfast consisted of a rice crispy bar, and a glass of orange juice. Her lunch consisted of a pack of peanut butter crackers (6 cracker pack), and aPepsi max. I explained the importance of drinking water to Dianna, and she said that she knows it is just hard to drink a lot as she only likes it super cold. Dianna is super nice, but she is an older client and I could see she is set in her ways. I could see that she may be a tough one to get through too, but I was determined to try and coach her with some nutrition tips. She was open to listening to me as she said she knows she needs to eat better, and balance her meals. I asked her if she could try an experiment for one week starting out with a meal plan I provide and see if she feels any different with her energy levels. She agreed. Ididask her what her energy felt like on a day shehas worked all day, then worked out and she said about a 5 on a 1-10 scale. The plan included the recommended amount for women which was 1 palm portion or protein dense foods with each meal, 1 fist of vegetables with each meal, 1 cupped handful of carb dense foods with each meal, and an entire thumb of fat dense foods with most meals (Hatfield, 2018, p.599). I would also recommend to her that she shouldincrease her sleep time to 8 hours a night to see how she feels after a week experimenting. At the end of the period I would ask Dianna what her energy level would feel like to see if it had increased closer to the 10 on the scale stated above. I would go over her overall protein intake to see if she followed the recommended portions I suggested as well. The third individual (Dallas) I met with that was new to the exercise and training scene told me that he skips meals at times, then eats meals that are too large where he feels bloated. He will work straight through lunch some days, and then eat a big supper at night as he feels like he is starving. He went on to tell me that doing the work of eating healthy is har d at times as he is surrounded by his friends that like to go eat at places where the food is not so healthy. I did ask him if his friends are the type that can eat whatever and never gain weight, and he said they are and that he doesnt think that is fair as he has to work so hard to try and stay healthy. I explained that is a frustrating part of this lifestyle, anda person doeswant to go eat with friends as I could seeDallas was a sociable person. Dallas then told me that he does not include the recommended amount of vegetables in his day either, but he does try and make time to eat at least one serving a day. He loves eating green beans and asparagus on the grill. With Dallas I incorporated the same kind of plan like I did with Dianna. I had him take a chart I provided to him wherehe is to take a diary ofwhat he eats for 3 days. I explained to him the daily recommendations for balanced meals with each mea which included: 2 palm portions of protein, 2 fists of vegetables, 2 cupp ed handfuls of carbs, and 2 thumbs of fat dense foods (Hatfield, 2018, p.598).I wanted him to try and understand theimportance of not skipping meals as he may not get the nutrients his body needs. I told him I would check back with him in three days and see how he feels, and to see how his energy level improves. As with any client, I will make sure to let them know that this is just a recommendation on starting the process. I will not come across as a trainer that has high expectations, as I will want to meet the client where they currently are and slowly help them build confidence in overcoming limiting factors in their lifestyle fitness journey. I will encourage clients to look at how they feel after trying these methods, and see where they struggle and what we can tailor to help them meet their needs so they can feel like they are meeting a goal they have set. The book explained the confidence method(Hatfield, 2018, p.602) and how it incorporated a scale on replacing an unheal thy snack with a healthy choice snack. It is better to have a client pick a decent method they can actually follow rather than a perfect method they quit after a few days (Hatfield, 2018, p.602). The individuals I chose let me use their name in this study. Hatfield, F. (2018). Fitness: The Complete Guide Official Text for ISSAs Certified Fitness Trainer Course. 9th ed. Same sex marriage is no longer a question of the legality of the subject; instead, people are now focusing on the aftermath of same sex marriage being legal. The legality of same sex marriage has forced multiple businesses a-nd religious organizations to adapt to the new ways of America in order to better suit the people of this great nation; however, not everyone is on board with the new movement including multiple people who refuse to serve the same sex community and their rights as citizens of the United States of America. The only way America can move on from its dark past is if the people of America can get over the fact that religion never promoted hatred and violence against others who did not seek it out. Religion was put in place to impose a better future for those who believe in a greater being that looks over us all. Answer: The offer is the first step of formation of a contract this expression defines a persons willingness for contracting in line with the specified terms. These terms further are made with the intention of making the terms of the offer binding as soon as the parties accept the same. There are two parties to an offer, (i) offeree to whom the offer is being made and (ii) offeror who makes the offer. An offer has three requirements (a) it needs to have exchange terms; (b) a willingness must exist for offeror to have the terms of the contract to be binding on him and (c) once the offeror has accepted the offer the offerree has the power to bind the offeror and the offeror cannot retract the offer once the same has been accepted by the offerree. The case of Pharmaceuticals Society of Great Britain opined that the goods which are displayed in a shop have been put there for allowing the customer to choose from them only. An offer however would be made only when an offer is made by the customer for purchasing. Thus Alan went to the store of Ben to look at the liquor on display since he wanted to purchase the same. This was only an invitation to treat since he was only looking. There was a counter offer that was made by Ben with respect to Alans request of buying Russian distilled vodka thus nullifying the initial treat to offer. Later upon insistence of Alan being the offeror that he wished to purchase only Russian distilled vodka Ben being the offeror assured him that the vodka provided by him would satisfy his requirement. It was opined in the Bannermans case that upon communication of a specific term by the offeror to the offerree the same shall be binding on the offeror. In the case of Ben and Alan there are specific terms which Alan communicate to Ben and it was in furtherance of these specific terms that the transaction was commenced. This was on the basis of this assurance that there was an acceptance of the offer and consequently the consideration was paid and the same acknowledged by way of receipt. The final element of a valid contract is that of legal capacity which broadly means that people who are either minors (in Singapore the age of majority is 18 years with effect from March 2009) or mentally incapacity do not have the capacity of forming a contract. Further it can be observed the Alan is an avid drinker hence a presumption can be made that he is not a minor further he also very clearly indicates his preferences and describes it correctly to Ben hence it is further presumed that he is not mentally incapacitated. In the case of Ben he is salesman for alcohol who is dealing deftly with the client hence presumption can be made that is not a minor nor mentally incapacitated. There has to exist the legal intention for creating a relationship that is legally recognized. There exists an intention to create a relationship that is legal because this is a contract of sale which is commercial in nature. Further based on the fact that there has been completion of the transaction and receipt provided for the same it can stated that there was an intention for creating a legal relationship. Thus, there has been a valid offer and acceptance, upon being assured that the alcohol is Russian Vodka he accepts the offer thus and paid to Ben the consideration for the same and a general rule exists that a promise will be enforceable only if there is a consideration attached to it. There is also a clear intention of forming a legal relationship and both the parties have the legal capacity to form a valid contract. There was quality of product however which Ben assured at the time when the purchase was being made however the alcohol that was purchased by Alan proved to be dangerous. Thus there has been a misrepresentation of the part of Ben and any contract which is formed on the basis of misrepresentation maybe set aside. Applicable Law Where there is a specific description of products that are being sold then it an implied condition under Section 13 that the goods should match the description of the properties that has been sold. It is with the products description and not the quality that this section is concerned with (Arcos v Ranaason [1933] AC 470). Therefore since Alan had specified that Russian distilled vodka was required by him and it was assured by Ben that the liquor was what had been requested by Alan hence the Sale of Goods Act section 13(1) would be attracted however the description of the product does not correspond with the product that had been specified by Alan. Though it can be assumed that Ben being only a salesman who was selling liquor may have unintentionally sold the liquor to Alan. It is not possible to take out the fault that was there in the alcohol without using any scientific method and even Alan and his friends realized that the liquor was not good when they had consumed it. However, it must be noted that this section 13 cannot be relied upon in those cases where the buyer has actually viewed the products (Harlington Leinster v Christopher Hull Fine Art [1991] 1 QB 564). Standard placed under section 14(3) wherein the buyer has informed the seller certain qualities that are required by the goods then there are higher standards. Under this the seller would be liable even if there is satisfaction of the safety aspect however the product is not the specific to that which the buyer had required(National Foods Ltd v Pars Ram Brothers (Pte) Ltd, 2007). It must also be noted further that the alcohol which was sold by Ben was not legal and as held in the case of Rowland vs. Divall when a product has been obtained by illicit or illegal method then the same shall not be justifiable. A receipt is when a party acknowledges in writing that they have from the person whose name has been mentioned on the receipt received a consideration as has been specified in the receipt. In the receipt sometimes apart from acknowledgment of receiving of particular this there is also an acceptance of doing from the agreement between the parties another thing. The receipt is however only a prima facie evidence of the contract which exists between the parties which is considered. For incorporating a written term in the contract and the same to be considered by the court one of the main requirements is that the terms incorporation notice has to be given either before the agreement to the contract or during the agreement to the contract. Thus in the given situation between Alan and Ben the receipt only an evidence of the contract between Alan and Ben acknowledging the consideration received and paid by the respective parties. It was established in the case of Olley vs. Marlborough Court Hotel case that for considering the terms to be incorporated into the contract it is necessary that there should be a notice of the same either at the time when the contract is being made or before the contract has been made(Olley v. Marlborough Court Hotel, 1949). In light of the aforementioned discussion and case law, it is clear in the situation of Ben and Allan the exclusion clause which was added to the receipt being that the products sold are not refundable nor the seller responsible for the safety of the products it was necessary for Ben to inform Alan of the same at the time of formation of contract or before the contract was to be considered to be a part of the contract since it was made known to him after the contract had been formed and consideration made it would not be an exclusion clause in the contract and Alan can claim damages from Ben as in the case of Olley vs. Marlborough Court Hotel. Further it is also essentialto notethat the it is in the document of contract that the exclusion clause should be incorporated. This document of contract is the one which any reasonable person should assume to contain the contracts terms and should not be just the mere acknowledgment of consideration being received like a receipt (Parker v. SE Railway Co., 1877). Application of Law For claiming damages for negligence it is first essential establish that a duty of care existed. A duty of care is said to exist if there is proximity between the plaintiff and the defendant. There is a test of reasonable foreseeability for establishing duty of care: There will be a duty of care that the defendant will owe towards the plaintiff where it can be foreseen reasonably that harm might be caused to the plaintiff due to omission or act of the plaintiff. There has been a breach of duty on the part of Ben when he sold the bootleg alcohol to Alan since it could have been reasonably foreseen by him that any person who would be drinking the alcohol could be harmed(Donoghue v Stevenson, 1932). In the case of Donoghue v. Stevenson the product liability principle was established in which it was stated that there existed a duty of care even when there was no contract or no proximity of parties(Donoghue v Stevenson, 1932). It also further stated that reasonable care should be taken for avoiding omissions or acts which can be foreseen reasonably that it is likely to injure neighbor. Neighbors under law are those who are directly and closely affected by the act (Donoghue v Stevenson, 1932). When it comes of sale of goods the duty of care is owed to the ultimate consumer even if there was no chance on inspection of the product. Thus keep in purview the product liability principles established it can be stated that a duty of care is owed towards the ultimate consumers and the neighbors to ensure that there has been no act or omission that would likely cause harm. Causation requires it to be necessary that negligence should be harms necessary condition, and that harm is falling within the defendants scope of liability. Issue of remoteness and causation are separately tended to, the but for test is the key tens when it comes to causation which basically question whether there could have been sustaining of the loss but for the negligence of the defendant. The case of Barnett v Chelsea and Kensington HMC (1969) is a leading case in this regard(Barnett v Chelsea and Kensington, 1969). Thus, since there has been a breach of duty on the part of Alan by selling harmful bootleg alcohol he would be held liable for it even by Alans friends and there is no remoteness of relationship since it was by drinking this alcohol that Alans friends had fallen sick. Also the product liability principle would be applicable in this situation and since Alans friends are the ultimate consumers there lies an action against Ben from them. Further in case of Alans friends and the alcohol supplied by Ben if we apply the but for principle it can clearly be stated that had it not been for the harmful alcohol they would not have fallen sick hence the harm falls within the scope of liability of Ben. Also in case of Alans friends and the alcohol supplied by Ben if we apply the but for principle it can clearly be stated that had it not been for the harmful alcohol they would not have fallen sick hence the harm falls within the scope of liability of Ben. Action can also be brought by Alans friends under the Chapter 53B "Contracts (Rights of Third Parties) Act" where the enforcement of contract terms can be done by third party. Under the neighborhood principle the friends shall qualify. References Articles and conditions of building contract.(2011). Singapore. Bannerman vs. White, 10 CBNS 844 (1861). Essay In the novel Nineteen Eighty-Four, the author, George Orwell employs a range of different techniques such as similes, metaphors and symbolism to unnerve and keep the reader in anticipation, impelling them to read on. The novel is in a third-person narrative style, this technique employed by Orwell creates a distance between the central character, Winston Smith and the reader. This vagueness adds tension and mystery to Orwells depiction, only allowing the characters emotion to be revealed through dialogue. The narrative viewpoint also allows the reader to grasp an unbiased view of the character and his circumstances. Throughout these first couple of pages Orwell purposefully refuses to expand on things which confuse the reader. For instance, The hallway smelt of boiled cabbage and old rag mats, and simply doesnt give an explanation why. This deliberate omission is employed to purely keep the reader on edge and impel him/her to read on. Another example of this is towards the end of the second page, The Patrols did not matter, however. We will write a custom essay on What does Orwell do in the opening two pages of the novel ? specifically for you for only $16.38 $13.9/page Order now Only the Thought Police mattered. This line immediately grabs attention and creates suspense, but Orwell leaves it here. The reader is now left feeling insecure and leaves us questioning ourselves through mere confusion of what may be happening in this society. Another technique utilized by Orwell to disturb the reader is the use of unusual contradictions; an example of this is given in the first line. It was a bright cold day in April, and the clocks were striking thirteen. After reading this opening line the reader becomes confused because usual connotations of the word Bright wouldnt normally be associated with the word Cold. Therefore a bright cold day would seem a little irregular but effectively creates atmosphere and tension, this poetic technique is called an Oxymoron. After this Orwell goes on to portray the clocks striking thirteen, this again, is a clever contradiction introduced by Orwell which directly unsettles the reader. The number thirteen itself is known as an unlucky number, associated with evil. These unusually dark connotations all add to the obscurity of the feeling Orwell is trying to depict and leave the read mystified about what is going to happen. In addition to this Orwell applies various similes, metaphors, repetition and symbolism to convey different emotions across to the reader. An example of the similes used is on the second page, a helicopter skimmed down between the roofs, hovered like a bluebottle. This clever expression compares the hovering helicopter with a bluebottle fly. The helicopter snooping about annoying and hassling people just like the hovering pest Orwell wants it to be related with. The repetition used within these two pages is based around the block capital written captions, BIG BROTHER IS WATCHING YOU. These headings are repeated twice; they are outstanding and emphasize the authority and presence of this establishment. Again, Orwell doesnt go into detail about what this organization symbolizes or stands for; he simply proceeds with the descriptions. This lack of knowledge of Big Brother leaves the reader wanting to know more about what control this unexplained leader has over the society. Furthermore, the symbolism which exploits this societys conduct with their people is portrayed through Winston Smith, the main character. Was thirty nine-nine and had a varicose ulcer above his right ankle and a small, frail figure, the meagreness of his body These descriptions of Winston prove that this society run by strangers, is under the unhealthiest of commands and nobody, especially Winston is treated correctly. These descriptions leave the reader with sympathy for Winston but still in a fearful atmosphere and anxious of what is going to happen. In conclusion to the question, George Orwell has employed successful and intelligent techniques that keep the story on a suspenseful edge whilst the reader and Winston Smith remain within a mysterious distance of each other. The distance is ample enough for the reader to be optimistic and impelled to go on. vickiburns199855http://www.blogger.com/profile/10383317327630292233noreply@blogger.com0tag:blogger.com,1999:blog-4704287588006341251.post-25338872639993686842020-03-08T22:46:00.001-07:002020-03-08T22:46:03.212-07:00An Overview Of The Gender Situation In The Philippines EssaysAn Overview Of The Gender Situation In The Philippines Essays An Overview Of The Gender Situation In The Philippines Essay An Overview Of The Gender Situation In The Philippines Essay The socio-cultural traditions are clashing with the MET and cyberspace generation. The long history of colonialism has embedded a patriarchal culture among Filipinos. The conception of women as full-time homemakers, as subordinated to men, violence against them is private, as reserve labor force, and as sexual objects is now being eroded by modern women asserting themselves in many aspects of life. But on the other hand, some are either reorganized, discriminated, or even exploited by the harsh realities of global economy and consumerism. Both the changes and the inertia of traditions are the backdrop of a very active and dynamic womens movement. The Philippines is a main player in the international womens arena and this is anchored on a very vibrant local womens movement. Numerous organizations and Nags exist for the cause of gender equality and other related women issues. This puts the gender equality issues at the forefront Of national discourse and precludes further downslide of women status in the modern Philippine society. Indeed, there are many handles for the changes to happen. These legal and policy gains resulted from the strong voice of women that started even during the anti-dictatorship struggle that culminated with the ascension of Corcoran Aquinas as the first woman president of the country. The 1987 Constitution states two prominent provisions. The first in the Declaration of Principles Article II Section 14 which asserted that The State recognizes the role of women in nation-building and shall ensure the fundamental equality before the law of women and men. Additionally, the Article XIII-Labor: Section 14 provided that The state shall protect working women by providing safe and healthful working conditions taking into account their maternal functions, and such facilities and opportunities that will enhance their welfare and enable them to realize their full potential in the service of the nation. Following from constitutional provisions and the subsequent efforts to broaden the its principles, numerous legislation were enacted that relates to the various aspects of women and gender concerns, The list include: Gender and Development Law (5% of government agencies budget is for gender concerns) Party-List Law (women as a particular sector for representation in the legislature through party-list elections) Anti-Sexual Harassment Law (defining SSH and providing mechanisms) Anti- Rape Law (elevation of rape as crime against person) Barraging Day Care Center Law (day care center for every village) Women in Nation-Building Law (allocation of budget for women from development funds from foreign governments and multilateral institutions) Anti Mail- Order-Bride Law (making the practice unlawful) Repatriation Law (repatriation of Filipinos who lost citizenship by marriage in case Of need) Non-Discrimination Law in Labor Code (women protection in hiring and pay) Comprehensive Agrarian Reform Law (equal rights for women to be recipients of land) Military Training equality (women can enter the military and police schools and providing facilities for them) While the legal framework is there, the actual situation mirrors the deep gender divide. In the aspect of women in politics, the notable success of overall women is overshadowed by the actual ground level statistics. The lady Vice-President is up to now a shoo-in in the next presidential elections in 2004. But the big picture shows that of all the elective positions occupied through the 1998 elections, only 15% are women. In the two-chamber Congress, the Senate (Upper House) has 17. 4% women membership (4 out of 23 seats) which the House of Representatives (Lower House) has 12. 4% (27 out of 217 seats). The first party-list elections in 1998 wherein sectors groups like women competed to get a maximum of 3 seats ere party in the House of Representativesresulted in the winning of one (1) seat for a single womens party. Five (5) Other womens party did not make the minimum votes required. At the local government level, women Provincial Governors constitute 17% while Vicegerents are at 1 1. 5% level. Among the City and Town Mayors, 14. 5% of them are women while the ranks of the Vice- Mayors are at low of 10. 8%. The labor force statistics show also a mixed picture. Since there was a notable finalization of the workforce in the past years, July 2000 figures showed that there are 1. 42 million unemployed women while there are 2. 31 million unemployed men. However, more women are taken in for labor flexibility arrangements especially in the big services sector like in retail trade. This leaves them exposed to employment insecurity and unfair compensation schemes. Women still accounts for 53% of the unpaid family workers while they constitute only 37. 7% of the wage and salary earners. Though this shows that the regular income possibilities for women are still limited, the average household annual income of female-headed families is higher. The situation also pushes them to seek employment overseas. Increasing numbers of domestic helpers and entertainers are also being deployed both legally and illegally. Within organizations, the gender balance is under overhaul. Trade union leadership is still male-dominated but women committees and affirmative actions have changed the complexion of decision-making. vickiburns199855http://www.blogger.com/profile/10383317327630292233noreply@blogger.com0tag:blogger.com,1999:blog-4704287588006341251.post-31656710050728044392020-02-21T13:13:00.001-08:002020-02-21T13:13:02.481-08:00How redefining the term "mistress" can illuminate other EssayHow redefining the term "mistress" can illuminate other confusing aspects of the poem "Sonnet 130", and potentially also, provide evidence about the poet's unknown identity - Essay Example However, the author has not specified this; his use of the term is ambiguous. The word mistress has three identified meanings. The word can be used in reference to a woman that has an ongoing- extra marital relationship, in many cases, with a man that is married. The second meaning of the term is as a prefix to the title that is bestowed upon a married woman ââ¬â MRS. Lastly, it is used to refer to a woman who holds a position of authority or who exercises control over something or someone. This paperââ¬â¢s focal point is to establish how various statements within the poem could be more sensible should be it taken to mean that his intention for using the word mistress was in the latter regard. From the language used, the author refers to someone that he did not fancy to be in relationship with. The line, ââ¬Å"And in some perfumes there is more delight than in the breath that from my mistress reeks (Shakespeare "Sonnet 130", 7-8),â⬠is the best illustration of this. Had Shakespeare, been referring to a lover, his description would not have been as blunt. This could be the true quality of a lover, due to the romantic regard lovers hold to each other; one is more likely to withhold this kind of information. Furthermore, lovers rarely concentrate on the negative attributes that their counterparts have, but rather chose to focus on the positive. Therefore, this disqualifies the notion that the author could have been using the word to refer to a person that he had for a romantic relationship. If one is in a romantic relationship, they are usually very fond of their counterpart. Therefore, they speak of them only in the most alluring and appealing fashion. However, from the poem, the author appears afraid of the person that they are referring. ââ¬Å"My mistresses eyes are nothing like the Sun (Shakespeare "Sonnet 130", 1).â⬠the statement itself illustrates that the author does not feel fond of the person in question. He does not feel vickiburns199855http://www.blogger.com/profile/10383317327630292233noreply@blogger.com0tag:blogger.com,1999:blog-4704287588006341251.post-59807123662050760942020-02-05T08:56:00.001-08:002020-02-05T08:56:03.395-08:00Shakespeare Essay Example | Topics and Well Written Essays - 1750 wordsShakespeare - Essay Example This paper examines the deposition scene in the two plays to draw out each kingââ¬â¢s relationship to kingship, his use of language, his mental state, his deployment of the Passion narrative, and his use of the crown as a prop. Following this analysis of the two kings, there is a discussion of the theatrical techniques the authors use to highlight the main issues at stake, for example the setting and role of the other characters in the deposition scene and the way that the drama unfolds on the stage. Finally the similarities and differences between Shakespeare and Marlowe are explained, leading to the conclusion that Shakespeare has borrowed some aspects from Marlowe but at the same time he has pushed Marloweââ¬â¢s art in a number of new directions. In the deposition scene (Act V, Scene i) Marloweââ¬â¢s King Edward II makes it very clear that he sees himself as belonging to a category that is very different from ordinary citizens: ââ¬Å"The griefs of private men are soon al layed;/ But not of Kingsâ⬠(Marlowe, lines 8-9). In order to illustrate the different elements in the social hierarchy, Edward uses animal imagery. The people are like ââ¬Å"the forest deerâ⬠(Marlowe, line 9), while he describes himself as ââ¬Å"the imperial lionâ⬠(Marlowe, line 11). ... In Shakespeareââ¬â¢s deposition scene (Act IV, Scene i) the king also assumes an entirely different and superior status, but his approach is much more sophisticated. King Richard makes the religious allusions even more obvious by the analogy of the Passion of Christ. Shakespeareââ¬â¢s King Richard implies that he is like Christ, while the usurper and his many followers are like Judas: ââ¬Å"So Judas did to Christ; but he, in twelve,/Found truth in all but one; I, in twelve thousand, none.â⬠(Shakespeare, line 171) The analogy is expanded, as the King accuses the bystanders of being like the Biblical Pontius Pilate: ââ¬Å"Though some of you, with Pilate, wash your handsâ⬠¦Ã¢â¬ (Shakespeare, line 239). Kingship in both plays is seen by the kings as a status that is fundamentally different from ordinary citizenship, and ordained by god, but it is depicted as something affected by the traitorous actions of other people. The two kings use language in different ways to express their reaction to the impending loss of their kingly status. Marloweââ¬â¢s king Edward II is aware that he is experiencing a great deal of negative feelings when he confesses that ââ¬Å"outrageous passions cloy my soulâ⬠(Marlowe, line 19) and he shows extreme ââ¬Å"rancour and disdainâ⬠(Marlowe, line 20) and speaks of ââ¬Å"the fury of your kingâ⬠(Marlowe, line 73). When Winchester addresses him as ââ¬Å"My lordâ⬠(Marlowe, line 113), Edward answers with short and angry commands: ââ¬Å"Call me not lord!/ Away, out of my sightâ⬠(Marlowe, lines 114-115) before he relents and realizes that he does not have the power to command any more. Gender-based inequality is a phenomenon that affects the majority of the worlds cultures, religions, nations and income groups [5]. When scientists speak of the gender gap these days, they are usually referring to systematic differences in the outcomes that men and women achieve in the labor market. These differences are seen in the percentages of men and women in the labor force, the types of occupations they choose, and their relative incomes or hourly wages [4]. There have been significant increases in the labor supply of women in the last decades both in developed and developing countries. For instance, in the United States female participation in the paid labor force changed drastically in the course of the 20th century: in 1880 only 17% of all American women at working ages participated in the labor market, by 2000 this number had risen to more than 60% [3]. Nevertheless, the Global Gender Gap Index 2007 showing that no country in the world has yet reached equality between women and men the highest ranking country has closed a little over 80% of its gender gap while the lowest ranking country has closed only a little over 45% of its gender gap. Factors that describe the gender pay gap Among various factors that describe the gender pay gap the most important ones are historical, cultural and economic. Describing historical factors of the gender pay gap, we have to mention that after industrialization women became secondary workers in the labor market; they entered the labor market in smaller numbers and for shorter periods than did men. Moreover, occupations and industries were highly segregated by sex, partly because employers developed explicit policies to segregate the workplace and bar married women from employment [4]. Hence the wage structure changes over time but the historical evolution of well-defined systems of jobs and firms has created relatively stable segmentation by occupation. As for cultural factors, they are closely connected to the historical events. The development of modern family patterns during the past decades has been accompanied by substantial changes in social norms, values and gender relations all over the world. In most of modern societies women with higher returns to human capital and fewer children, increase their investments in education and their attachment to the market. The economic factors are also very important. Because women are very likely to interrupt their career for children bearing period, and employers avoiding workers with high quit rates (for economic reasons), therefore, women comparing to men are less likely to receive stable well-paid jobs. Micro-level processes that cause the gender pay gap As wage differences among workers can be explained by processes that match individuals to jobs, we should research how individual women and men are sorted into different positions and thereby obtain different levels of reward. Margaret Mooney Marini and Pi-Ling Fan have conducted a research The gender gap in earnings at career entry in which the micro-level mechanisms of the gender wage gap were investigated. Those are gender differences in job-related skills and credentials, adult family roles, work and family aspirations, the availability and use of information and influence via social networks; gender discrimination in hiring and job placement by employers. The results of the research showed that explanatory mechanisms focusing on the characteristics of workers explained only 30 % of the gender difference in wages. But the gender differences in aspirations and in job-related skills and credentials were the most important in accounting for the gender pay gap. The allocation of women and men to different jobs by employers, and informal processes of social contact and social interaction via networks play an important role in wage determination at career entry. Moreover, gender differences in family structure had no significant direct effect when the effect of worker qualifications and aspirations were considered [6]. How to measure the gender gap One of the instruments to measure the gender gap is the Global Gender Gap Index introduced by the World Economic Forum. This index is a framework for capturing the magnitude of gender disparities. It aims to be a tool for benchÃâà marking and tracking global gender-based inequalities on economic, political, education- and health-based criteria [5]. The structure of this index is in the Appendix. In this paper we are interested only in the economic participation and opportunity analyzed by the Index. This area is captured through three concepts: the participaÃâà tion gap, the remuneration gap and the advancement gap. The participation gap is captured through the difference in labor force participation rates. The remuneration gap is captured through a hard data indicator (ratio of estimated female-to-male earned income) and a qualitative variable calculated through the World Economic Forums ExecuÃâà tive Opinion Survey (wage equality wages for similar work). Finally, the gap between the advancement of women and men is captured through two hard data statistics (the ratio of women to men among legislators, senior officials and managers, and the ratio of women to men among technical and professional workers). Conclusion The gender gap is a difference in outcomes that men and women achieve in the labor market. Because labor market rewards derive from labor market positions, it is important to understand why women receive less rewarding positions and what the mechanism of the gender pay gap is. There are historical, cultural and economic factors that influence gender pay gap. Historically occupations are segregated by sex, but women return to human capital more often than in the past and decrease their quit rates during childbearing period. Among micro-level processes that cause gender pay gap, the most important are gender differences in aspirations, job-related skills and definite social networks inclusion. In order to measure gender gap scientists use the Global Gender Gap Index which examines the gap between men and women in four fundamental categories: economic participation and opportunity, educational attainment, political empowerment, health and survival. Sonny Essay -- essays research papers The Godfather: Michael Vs. Sonny à à à à à At a first glance Michael and Sonny appear to be quite different. Upon further observation, however, they have some similarities. Although they are different in areas of personality, values, and their tempers, they are similar in areas of loyalty, their respect for their father, and their strong family ties. à à à à à Their personalities are quite different. Sonny is brash and arrogant, where Michael is calm and cool. When Don Corleone was in the hospital and Sonny is in charge, the family got kind of careless. He doesn't seem to care what could happen due to his actions. He wants to kill the police captain and doesn't think about the repercussions. Tom has to tell him that it wouldn't be good to kill a cop, but they end up doing it anyway. I think Michael was pushed into it because of his loyalty to the family. He is more calculating in manner. Am I more American because my skin is white and I speak perfect English? Or am I more American because my family immigrated here 100 years earlier than most? Our country is a melting pot of different races, backgrounds and beliefs. Two women, who are the children of immigrants, share their stories of growing up in America. The first is Gloria Anzaldua, a Chicana who grew up in South Texas. The first chapter of her book, Borderlands/La Frontera: The New Mestiza is titled ââ¬Å"How to Tame a Wild Tongueâ⬠. She describes life as a young woman who is too Spanish for Americans and too American for Spanish. The second is Amy Tan, a daughter of immigrants who fled China in the 1940s. In her essay ââ¬Å"Mother Tongueâ⬠she recalls growing up with a Mother who could not speak perfect English. While these women are from two different backgrounds, their experiences with languages are the same. Both women have expressed the idea that language used with family, the educational system and society shape us as individuals. When a person is at home, surrounded by those who are nearest and dearest to them, they let their guard down. The languages we speak around our families are often different from the ones we use in the professional world. Tan states this opinion in her essay; she remembers a time when she was conscious of the English she was using around her mother. She was walking down the street with her mother and using the English that she did not use around her mother. She also states that this is the same type of English she uses with her husband. She writes that this type of language ââ¬Å"has become our language of intimacy, a different sort of English that relates to family talk, the language I grew up with.â⬠(Tan, page 143) Anzaldua has a similar opinion when it comes to the language of our family; she writes ââ¬Å"My ââ¬Å"homeâ⬠tongues are the languages I speak with my sister and brothers, with my friends.â⬠(Anzaldua, page 134) Her type of language is a considered a subcategory of Spanish, called Chicano Spanish. Anzaldua also explains that in her culture she had to learn different dialects of Spanish, according to region that person was from. These two women played chameleon with their languages, blending in perfectly with their surroundings, wearing a mask to the world until they were home. At home, they were safe to use the language they grew up using without fear of judgment. ââ¬Å"To get a good job, you need to speak English well. Whatââ¬â¢s the use of all your education if you speak English with an accent?â⬠(Anzaldua, page 132) Anzaldua grew up with the idea that her imperfect English would limit her opportunities, even with an education. When she became a high school teacher, she was reprimanded for giving her students literature by Chicanos. Tanââ¬â¢s educational experiences were somewhat different than Anzaldua. Her limitations were set by test scores in English and Math. Tan writes that her English scores ââ¬Å"were not good enough to override the opinion that my true abilities lay in math and science, because in those areas I achieved Aââ¬â¢s and scored in the ninetieth percentile or higher.â⬠(Tan, page 145) While both women felt limited in their educational world, they both found a love for writing. They both became a voice for their people. One thing that shapes a personââ¬â¢s perspective of themselves is how their society views them. Tan, at a young age, would often have to speak for her mother. Her motherââ¬â¢s English was view as ââ¬Å"brokenâ⬠or ââ¬Å"limitedâ⬠by society. This had a profound effect on how Tan viewed her motherââ¬â¢s English; she writes ââ¬Å"because she expressed them imperfectly her thoughts were imperfect.â⬠(Tan, page 144) Anzalduaââ¬â¢s Chicano Spanish was viewed as ââ¬Å"poor Spanishâ⬠by society. ââ¬Å"If a person, Chicana or Latina, has a low estimation of my native tongue, she also has a low estimation of me.â⬠(Anzaldua, page 136) Society, the community in which these women lived, has looked down on the English that they speak. Both women feel that their language is ââ¬Å"poorâ⬠, ââ¬Å"brokenâ⬠, or ââ¬Å"limitedâ⬠by societyââ¬â¢s standards. Gloria Anzaldua and Amy Tan were raised in two different cultures, with two different types of English. They grew up in families that spoke with accents and different dialects. Both women navigated their way through the educational system, which was not designed with them in mind. They were also viewed by their communities as being limited because their home language was not the standard. These two women also fought the system that wished to limit their voices. They became writers, they wrote their stories of how their language, for better or worse shaped who they were. vickiburns199855http://www.blogger.com/profile/10383317327630292233noreply@blogger.com0tag:blogger.com,1999:blog-4704287588006341251.post-49029819568175019602020-01-03T18:30:00.001-08:002020-01-03T18:30:02.534-08:00Why Students Should Study Abroad Essay - 1369 Words Education gives the ability and flexibility to engage in many opportunities during life. Peter Gray, a research professor and an author for Psychology Today, shares that from the beginning, education was given to children through exploring and learning from oneââ¬â¢s own mistakes. Society today sets apart buildings, schools, and universities giving a more in depth education to children and adults instead of allowing them to learn from them and nature. Today, the many different methods of educating students include, classroom learning, homeschooling, online learning, and studying abroad. Each method uniquely shapes and teaches students differently. Studying abroad and classroom learning, especially in America, hold factors proving beneficial to those pursuing their education. One reason why students should study abroad is because of academic opportunities the experience provides. Studying abroad allows them to explore and learn from themselves; in addition to, they also learn in a traditional classroom environment. The Texas AM Univeristy of Kingsville article, ââ¬Å"Reasons to study abroad,â⬠acknowledges that going overseas while unfamiliar with a country s location, culture, and language, forces the overseas learner to adapt to their environment. This helps the learner become more independent and develop better language skills. Many employers, universities, and colleges look for these attributes when individuals apply. At that time, regular mail delivery took up to three weeks to cross the continent. The Pony Express carried mail rapidly overland on horseback the nearly 2000 miles between St. Joseph and Sacramento; the schedule allowed ten days for the trip. The mail was then carried by boat to San Francisco. Stations averaging at first 40 km (25 mi) apart were established, and each rider was expected to cover 120 km (75 mi) a day. Pony Express riders were usually lightweight young men, often teenagers. Special saddle bags that could be moved to a fresh horse very quickly at a change station were used. Buffalo Bill was a famous Pony Express rider. Eventually, the Pony Express had more than 100 stations, 80 riders, and between 400 and 500 horses. The express route was extremely hazardous, but only one mail delivery was ever lost. The Pony Express is credited with helping to keep California in the Union by providing rapid communication between the two coasts. News of the election of Abraham Lincoln to the United States presidency in 1860 and of the outbreak of the American Civil War in 1861 reached California via the Pony Express. The regular Pony Express service was discontinued in October 1861, after the Pacific Telegraph Company completed its line to San Francisco. The Pony Express was developed by William H. Russell, William B. Waddell, and Alexander Majors. Financially, the Pony Express was a failure, leading its founders to bankruptcy. However, the drama surrounding the Pony Express made it a part of the legend of the American West. Bibliography Pony Express, Microsoft? Encarta? This rare element has no stable isotopes. Its found in uranium ores and cigarette smoke and also occurs as a decay product of heavier elements. Although there arent many applications for the element, it is used to generate heat from radioactive decay for space probes. The element is used as a neutron and alpha source and in anti-static devices. Polonium has also been used as a poison to commit assassinations. Although the position of element 84 on the periodic table would lead to categorization as a metalloid, its properties are those of a true metal. Although he was a no-nonsense, competent executive, David was one of the most popular managers in the company. This Friday morning, however, David was not his usual self. As chairperson of the companyââ¬â¢s job evaluation committee, he had called a late morning meeting at which several jobs were to be considered for reevaluation. The jobs had already been rated and assigned to pay grade 3. But the office manager, Ben Butler, was upset that one was not rated higher. To press the issue, Ben had taken his case to two executives who were also members of the job evaluation committee. The two executives (production manager Bill Nelson and general marketing manager Betty Anderson) then requested that the job ratings be reviewed. Bill and Betty supported Benââ¬â¢s side of the dispute, and David was not looking forward to the confrontation that was almost certain to occur. The controversial job was that of receptionist. Only one receptionist position existed in the company, and Marianne Sanders held it. Marianne had been with the firm 12 years- longer than any of the committee members. She was extremely efficient, and virtually all the executives in the company, including the president, had noticed and commented on her outstanding work. Bill Nelson and Betty Anderson were particularly pleased with Marianne because of the cordial manner in which she greeted and accommodated Farringtonââ¬â¢s customers and vendors, who frequently visited the plant. They felt that Marianne projected a positive image of the company. When the meeting began, David said, ââ¬Å"Good morning. I know that youââ¬â¢re busy, so letââ¬â¢s get the show on the road. We have several jobs to evaluate this morning and I suggest we begin Before he could finish his sentence, Bill interrupted, ââ¬Å"I suggest we start with Marianne. â⬠Betty nodded in agreement. When David regained his composure, he quietly but firmly asserted, ââ¬Å"Bill, we are not here today to evaluate Marianne. Her supervisor does that at performance appraisal time. Weââ¬â¢re meeting to evaluate jobs based on job content. In order to do this fairly, with regard to other jobs in the company, we must leave personalities out of our evaluation. â⬠David then proceeded to pass out copies of the receptionist job description to Bill and Betty, who were obviously very irritated. See questions below. ob can be reclassified / re-evaluated if the duties or responsibilities of an employee have significantly changed or expanded over time, and the expanded duties have remained in place for at least six months. In these cases, the same review criteria are used as with new positions. Based on the rating system, the employee may be moved to a higher pay band, and may receive retroactive pay. QUESTIONS 1. Do you feel that David was justified in insisting that the job, not the person, be evaluated? Discuss. Job evaluation is a technique used to determine the value of each job in relation to all jobs within the organization. The job evaluation and the employee evaluation are based on two entirely different scales. The job evaluation clearly identifies and describes the task, creates the basis for the job description and relates to the tasks involved with the position itself The basic purpose of job evaluation is to eliminate pay inequities which may exist because of illogical pay structures, such as might develop over time if care is not taken in how compensation is determined. Job evaluation programs are generally administered by the human resource department and are usually conducted by a committee. The jobs people have are major determinants of the amount of financial compensation they will receive, and organizations pay for the value attached to certain duties, responsibilities, and other job-related factors, such as working conditions. The relative worth of jobs is usually determined through a combination of job analysis, job descriptions, and job evaluation. The employee evaluation measures the employees overall performance of their tasks as it relates to the overall success of the company. David was asked to evaluate the job for compensation purposes, which involves the job function, not the person who is performing the job. I do feel that David was justified in insisting that the job, not the person be evaluated. 2. Do you believe that there is a maximum rate of pay for every job in an organization, regardless of how well the job is being performed? Justify your position. Employers use pay scales to calculate salaries. The rate range for a job grade consists of a minimum, midpoint, and maximum rate of pay unrelatedly to how well a job is performed. Many employers use a system job evaluation tool to rank jobs based on skill, education, experience, and duties to assess the job description. There should be a maximum rate of pay, which should be based on the individualââ¬â¢s job performance. The starting rate and maximum rates should be the same for all employees in the same position but, their individual rates may be different depending on their performance. However, once an employee has reached the maximum rate of pay for the position the employee should not receive any more pay raises. A job should have its maximum pay rate depending on many factors. In most cases jobs that do not require high level of education are the jobs that do not lead to a life long career. In this case, there is a limit of value that a receptionist like Beth could bring to the company. It wouldnââ¬â¢t make much financial sense to pay a receptionist equal to an operations manager. Even in this example where the receptionist has elevated value due to her interpersonal skills, ultimately she does not provide attainable financial betterment to the company outside of her job description. Therefore, the employee should be paid based on their quantified value as an asset to the company; and a job should have a maximum rate of pay. vickiburns199855http://www.blogger.com/profile/10383317327630292233noreply@blogger.com0tag:blogger.com,1999:blog-4704287588006341251.post-31306083898775750582019-11-21T05:07:00.001-08:002019-11-21T05:07:05.585-08:00Help writing executive summary of advertising plan AssignmentHelp writing executive summary of advertising plan - Assignment Example Similarly, Starbucks faces various threats that include stiff competition, increased prices for avocado and reduced sales in the US retail outlets. The firm is a part of the Samsung conglomerate that provides a number of services and products. The firm has been able to establish a large enough market niche, overcoming global giants such as Apple, BlackBerry and Nokia. In terms of its Smartphone sales, Samsung has been able to provide a strong competition in the global market, and this has enabled the firm to be able to increase its sales and revenues. However, although Samsung has been able to capture a big market share on the global market, the firm has not been able to capture the Canadian market where its main competitor, Blackberry, has a stronghold on the market. This is critical because the Canadian market is a particularly good one given the fact that the market is a high end market, with numerous potential customers. Goals To be the market leader Samsung intends to be the market leade r in consumer electronics. ... It also aspires to be able to deliver the best most innovative products especially in the smart phone industry. Increase a cream of the market customer base (price skimming) In the technology industry, price skimming is the best way for firms to get their research and development costs returned as soon as possible. Price skimming refers to the firm being able to sell of a new innovative product and a considerably high price to those people who are can to pay more to be the first to use the product (Baker and Hart 2008). Once this happens, the firm recovers its research and development costs which were incurred in developing that product. The firm can now sell the product to the lower market at a lower price. Since Samsung has a global market, the Canadian market could be the best market to act as its high profile market. Although the market for Samsung is a global one, it fails to have a market stronghold in market areas where the firm can use the market for price skimming. This is b ecause of a number o reasons. First one is the fact that the main markets where Samsung has a stronghold on the market cannot be used for effective price skimming. Black Berry has a stronghold in all the high profile markets, and this makes it possible for Black Berry to use price skimming. This ability also makes it possible for Black Berry to be able to invest properly without worrying about its research and development costs (Martin 2013). If Samsung is able to increase its market share in the Canadian market, it will also be able to do effective price scheming and thus positively affect its research and development process. We also see that George can put Lennie down at times when George is annoyed at Lennie. Although from reading section three I can tell that their relationship is slowly becoming closer and a kinder one. Firstly, George is starting to make Lennie seem a little happier and to show him that he is not all bad at things. We can see this on page 43, line 4, ââ¬Ëheââ¬â¢s sure of a good worker. Strong as a bull.ââ¬â¢ This shows that George is at least trying to make Lennie feel good about himself. Another example of this can be seen again on page 43, line 11,ââ¬â¢ he can do anything you tell him, said George. Heââ¬â¢s a good skinner.ââ¬â¢ This quote could mean that George really does deep down love Lennie as a friend. Secondly, the other hand George can be harsh to Lennie on the odd occasion where George is trying to be funny. A quote for this can be found on page 45, line 5,ââ¬â¢ I wasnââ¬â¢t kicked in the head with no horse, was I, George? Be a darn good thing if you was, George said viciously. Save everââ¬â¢ body or hell of a lot of trouble.ââ¬â¢ We can tell from this that George tries to make himself laugh by saying bad things about Lennie. Thirdly, Lennie seems that he does not really seem to make a matter of that he is being treated badly by George sometimes. We can see this on page 43, line 7, ââ¬ËGeorge scowled at him, and Lennie dropped his head in shame.ââ¬â¢ This shows that he is upset by how he drops his head but doesnââ¬â¢t say anything back to try and defend himself. Shows that he is getting bullied by George a bit. Fourthly and finally another way their relationship builds up is how they always dream of the future and how they both want the best for each other also how they sort of know that it will be all good. Iââ¬â¢m guessing that they will talk about the future a couple more times later on in the book. So from reading section 3 we can see that their relationship is very slowly getting better and their bond is getting tighter but George sometimes slows the relationship down, but can say good and positive things about Lennie on the odd occasion. vickiburns199855http://www.blogger.com/profile/10383317327630292233noreply@blogger.com0tag:blogger.com,1999:blog-4704287588006341251.post-13157780138884329062019-11-15T02:25:00.001-08:002019-11-15T02:25:05.422-08:00The Effect of Television on Humans Essay -- TV Media PapersThe Effect of Television on Humans "98% of all homes in the U.K. have at least one television in them"Throughout our planet we are surrounded by media, through magazines, newspaper, internet, radio and, the most influential, television we are educated the news of the world. Just over 96 years ago the first working mechanical TV system was built, by a man name Boris Rosing, and itââ¬â¢s now, in the 21st century the considered the most popular form of entertainment. It is adored by all ages and has become an essential part of the lives of millions of viewers. Television, as many researchers and scientists have said, influences the thoughts of its audience in good and, unfortunately bad ways, with TV broadcasters doing whatever necessary to profit from their shows. Television has a big impact on the youth of today, is the fact that our children are able to view scenes of sex, violence and excess bad language at such an early age have an affect on their futureââ¬â¢s? DOES TELEVISION INFLUENCE OUR BEHAVIOUR AND CAUSE US TO BE MORE VIOLENT? The programs watched on TV obviously depend on the preferences of the viewer(s), but the majority of people will watch films quite frequently. ââ¬ËAction moviesââ¬â¢ have forever been the most popular genre due to the extreme amounts of violence throughout the film. The characters in these films are made to look ââ¬Ëcoolââ¬â¢ when fighting or shooting one another. It has been found that youngsters who continually watch these ââ¬Ëaction moviesââ¬â¢ are more likely to solve problems with violence a... ...nding us. As you can see there are advantages and disadvantages to the television, there is no doubt television influences our attitudes, behaviors and beliefs. Reality shows, Talk Shows, and Soap Operas all contribute to us being prevented from seeing the real truth in our society and what is considered important or not. On the other hand TV is extremely educational and is probably the greatest form of media. I believe that TV should not be an essential part of our daily lives, moderate amounts of it is certainly harmless, if not advantageous. By the time a child becomes an adult, he has witnessed over 12,000 acts of violence on a television screen per year. That equals 144,000 acts of violence between the ages of 5 and 18. The child has witnessed over 8,000 murders before finishing elementary school (APA 1997). vickiburns199855http://www.blogger.com/profile/10383317327630292233noreply@blogger.com0
